With the rise and persistence of cryptocurrencies and other digital assets, now, perhaps more than ever, trustees and other fiduciaries must have a working understanding of how these assets function, which opportunities and pitfalls they present, and how to comply with California’s web of fiduciary duties. This presentation is aimed at helping build the foundational knowledge that fiduciaries and T&E practitioners need to navigate this complex intersection of technology, finance, and the law. It also offers insights on practical steps that a prudent fiduciary may want to consider when administering such assets, including marshalling such assets using RUFADAA and other unique approaches, procuring third-party custody, and retaining crypto-specific investment expertise/advice.
