Settlements can have significant tax implications for businesses and individuals on both sides of a lawsuit. Anticipating those issues in advance of settlement discussions and if necessary, getting the appropriate tax advice, will go a long way to protecting your client before you get to the negotiating table. Correctly evaluating tax aspects of settlements and documenting settlement terms, as well as the correct reporting of settlement payments, is critical to obtaining the best result possible. Our presenter, former head of the SDCBA Tax Section, and tax-controversy practitioner, Mitch Dubick, Esq. will also discuss some of the red flags which suggest when tax advice should be sought in the employment, divorce, and general civil litigation arenas.
